Simon Delon Photography (trading name of Pro Vision Photography Limited). Photography Terms & Conditions (for Wedding, Portraiture, Event, Corporate & Other Services). 

It is mutually agreed that the following terms of agreement form an integral part of this contract and that no variation or modification of this contract shall be effective unless accepted by Pro Vision Photography Ltd in writing. 

Booking Reservation Fee

The booking reservation fee of 25% (unless a different percentage fee is agreed in writing) of the total package fee covers our expenses, administration costs and secures the time/services of the photographer(s) for the wedding. This is payable at the time of booking our services and is not refundable. Bookings are made strictly on a first come first served basis. Dates will only be reserved upon receipt of the full booking reservation fee. 

Payment Terms

The remainder of the fee is due to be paid in full at least 28 days prior to the wedding date booked. Payment for all additional albums, re-prints, enlargements or any other work or services must be paid for in full at the time of ordering. Late payments may require an additional fee and non-payment of the outstanding balance before the date of the wedding may result in the cancelation of this contract without the return of the booking reservation or any other fees, all at the descretion of Pro Vision Photography Ltd.

Cancellation

The client may cancel this contract at any time by giving written notice to the photographer/s but in doing so shall forfeit any monies paid. Should cancellation be received by the photographer/s less than 12 weeks prior to the date of the ceremony, the client shall in addition pay a sum equal to 50% of the contract value. The said sum shall be payable as compensation as an estimate of the loss the photographer/s would suffer. 

Display

The client hereby agrees to allow the photographer/s and Pro Vision Photography Ltd to display any images/photographs covered by this contract within any studio, portfolio, internet site, display areas, exhibitions, advertising, press, media, competitions, slide shows or for other commercial uses. 

Reorders

All reorders shall be treated as an extension of this contract and no responsibility for errors will be accepted unless orders are given in writing.

Special Requests/Coverage

The client understands and accepts that the photographic coverage will be as the photographer’s professional expertise determines and that no photograph will be deemed more important than another. Special requests are not a binding instruction, although every effort is made to comply with the client's wishes. Pro Vision Photography Ltd will not be held responsible for the non co-operage/absence of guests in our photographs, adverse weather conditions or other circumstances which may influence the outcome of the photography. Any special requests not notified on this booking form must be made by the client to the photographer/s in writing. 

Alterations to Wedding Date/Time

Any alteration to the wedding date and time may induce a further payment as deemed necessary by Pro Vision Photography Ltd. 

Photographs

All photograph sizes are nominal. The photographer will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials, especially man-made fibers. It is sometimes impossible to record photographically the exact colour of materials as seen by the human eye; therefore all colour balances are purely perceptional. The photographer will provide proof photographs. If you are also placing an order for any albums you may choose which photographs you would like in your album. We use our expertise to edit down to the best photographs for any proof selection offered. 

Copyright

The 1988 Copyright Design and Patents Act section 77 & 80 assigns the copyright of the photographs taken, to the photographer. It is contrary to the Act and an offence to copy or allow to be copied, the photographs covered by this contract by any means. Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/ electronically or by any other means an image created as part of this contract without the permission of the photographer/s in writing. Any breaking of seals in any viewing album will presume a breach of copyright. 

Digital Files/Negatives etc

Negatives/digital files remain the property of the photographer/s. 

The Photographer/s, Force Majeure and Act of God

On occasions and without notice it may be necessary for the photographer originally specified to be substituted by another photographer, (e.g. due to ill health). The due performance of the work detailed above is subject to the photographer's alteration or cancellation owing to any cause beyond his/her control. The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control. In the unlikely event of the photographer's cancellation the following will apply:- Arrangements will be made for another photographer of comparable standard to cover the event with agreed fees remaining unchanged; if the photographer finds that providing a replacement photographer is not possible such as there not being a photographer available, a full refund will be given of all monies paid for services not received to the date of cancellation.

Previews

Although the photographer will do his best to produce more proofs/preview prints than set out in the brochure/as discussed with the client, there is no guarantee that any particular number of proofs/preview prints will be produced. 

Insurances

Simon Delon Photography is a trading for the wedding and portrait photography services for Pro Vision Photography Ltd and is fully insured for the professional photography services provided as advertised. Insurance cover includes: Professional Indemnity £100,000, Public Liability £5,000,000, Employers Liability £10,000,000. The client is aware that they have opportunity and shall be equally responsible for any wedding insurance policy which may be taken out by themselves with a reputable insurance provider and to be in force for the various relevant circumstances relating to the wedding and all the various services provided.

Limitation of Liability

In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss. 

Images/Image Files

The images/digital image files remain the property of the photographer and or Pro Vision Photography Ltd. All image sizes are nominal. The photographer/s will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to record the exact colour as seen by the human eye. 

Retouching

Retouching, digital manipulation such as in Adobe Photoshop software and artist finishing is available to the client as an optional extra.

Licence

The photographer/s shall be granted complete artistic licence including in relation to the poses photographed and the locations used. The photographer/s’ judgement regarding the locations/poses and number of images taken shall be final. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested. 

Complaints

Any complaints should be raised by the client with the photographer/s, in writing, within 28 days of first becoming aware of the matter to be complained of and in any event within 28 days of receipt of the images. 

Jurisdiction

This agreement is governed by English Law 



AGREEMENT

In booking Pro Vision Photography Ltd (to also include trading as: Simon Delon Photography) for the wedding I/we hereby assign the photography of the wedding to Pro Vision Photography Ltd. I/we further agree to the provision for payment as outlined above. I/We agree to the terms of business as set out above and within it. I/we understand that the terms of this agreement cannot be changed unless agreed by both parties in writing.

This in no way affects your Statutory Rights.
